Welcome to aa-intergroup.org. This website is owned and operated by OIAA, Inc., a New Jersey corporation (“Online Intergroup of Alcoholics Anonymous” or “OIAA”). It provides general information and services to online A.A. groups across the globe through an extensive international meeting list, events, information and various services, subject to these Terms and Conditions of Use (these “Terms”).
As used in these Terms, the term “Website” or “Site” refers to the website located at aa-intergroup.org as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto, along with online services and communications that may include, but are not limited to, OIAA email announcements, blogs, events, archives, online content, online discussion forums and A.A. meeting listings.
By accessing, browsing and/or using the Website, you, personally or on behalf of an entity (“You”) agree to comply with and are bound by these Terms and the provisions of the Privacy Policy. OIAA reserves the right to change or modify these Terms or the Privacy Policy without notice at any time by posting updated versions on the Site. Your continued use of the Website constitutes your agreement to be bound by the revised Terms and revised Privacy Policy. If you do not agree with the Terms or the Privacy Policy in their entirety, please do not use the Site.
Site Functionality, Maintenance and Use
The information contained on the Website is provided by OIAA as a service to you for your personal use on an “as is, as available” basis. OIAA assumes no responsibility for errors or omissions in the content at the Site. OIAA makes no commitment to update the information at the Site or to correct any errors, even if OIAA is aware of outdated or inaccurate information contained herein.
OIAA periodically schedules system updates for maintenance and other purposes. Unplanned outages also may occur. OIAA shall have no liability for the resulting unavailability of the Website or for any loss of data or transactions caused by planned or unplanned system outages, or any outages of web host providers or the Internet infrastructure and networks external to the Website.
We also reserve the right to modify or discontinue all or part of the Site, including any particular functionality or information, without notice at any time.
You should take precautions when downloading files from any and all websites, including from the Website, to protect your computer from viruses and other destructive programs.
The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.
The Site is intended for users who are at least 18 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Site. If you are a minor, you must have your parent or guardian read and agree to these Terms prior to you using the Site.
As a user of the Site, you agree not to:
- systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us;
- make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses;
- use the Site to advertise or offer to sell goods and services;
- circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any content or enforce limitations on the use of the Site and/or the content contained therein;
- trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords or meeting codes;
- make improper use of our support services or submit false reports of abuse or misconduct;
- interfere with, disrupt, or create an undue burden on the Site;
- attempt to impersonate another user or person or use the username of another user;
- use the Site content for any revenue-generating endeavor or commercial enterprise;
- decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site;
- upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including spamming, that interferes with any person’s uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site; or
- disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site.
Disclaimer of Warranty; Limitation of Liability
THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, OIAA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT WILL OIAA OR OIAA’S OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, INABILITY TO ACCESS THE SITE OR OTHERWISE RELATING TO THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF OIAA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Because some jurisdictions do not allow the exclusion or limitation of liability for negligence, consequential or incidental damages, in such jurisdictions OIAA’s liability shall be limited to the greatest extent permitted by law.
Your sole and exclusive remedy for dissatisfaction with the Website is to stop using the Website.
Further, OIAA is not responsible for the accuracy, reliability, timeliness, completeness, appropriateness or usefulness of any information given, or of any statement made, by the members, third party companies, or users whose profiles or A.A. meeting listings are on the Website, or for the content, services, products, or advertising on or available from members, A.A. meeting listings or third party websites, or for the availability and operations of their websites. OIAA is also not responsible for anything which takes place or any statements made at meetings accessed on third party platforms which are included in A.A. meeting listings at the Site.
Neither information on the Site, nor any comments from members, including through email communications initiated by website contact or at meetings, shall be deemed to be legal, medical or other professional advice. For answers to specific questions concerning your situation, you should consult with appropriate licensed professionals who can advise you regarding your particular circumstances. OIAA expressly disclaims any responsibility for any such advice.
No Endorsement
The listing of any vendor, consultant, expert, A.A. meeting or other resource on the Website does not imply that OIAA endorses that vendor or A.A. meeting in any way. You agree to conduct your own due diligence in connection with evaluating any resource, consultant, vendor or expert, or A.A. meeting. While OIAA selects companies and organizations for goods and services, OIAA shall have no responsibility for the quality, reliability, performance or nonperformance by such providers.
Links from Other Sites
From time to time, other websites may provide hypertext links to the Site. Except for member sites, no such links shall imply any relationship or connection between OIAA and the operator of the website containing the link to OIAA’S website. OIAA has no liability to you arising out of your use of any website that provides links to the Site, including links to A.A. meetings and events.
Links to Other Sites
As a convenience to you, the Site may periodically provide links to third party websites where OIAA deems it is appropriate. OIAA’s decision to link to a third-party website is not an endorsement of the content in that linked third-party website. OIAA is not responsible for the content of any third-party web site, nor does OIAA make any warranties or representations, express or implied, regarding the content (or the accuracy, reliability, timeliness, completeness, appropriateness, or usefulness of such content), offensiveness, opinions, privacy practices, or other policies on any third-party web sites, and OIAA shall have no liability of any nature whatsoever in relation to any of the foregoing. If you decide to access linked third-party sites, you do so at your own risk. You should direct any concerns to the third-party sites’ administrator or webmaster, or A.A. meeting host groups.
Trademarks
The trademarks, logos and service marks (“Marks”) displayed on the Site are the property of OIAA or other third parties. You are not permitted to use these Marks without the prior written consent of OIAA or such third party which may own the Mark.
Copyright
All materials published by OIAA on the Site are protected by copyright laws, and may not be copied, reproduced, aggregated, republished, uploaded, posted, distributed, transmitted, resold, displayed, broadcast, encoded, sold, licensed, or otherwise exploited in any manner or for any commercial purposes without the express written permission of either OIAA or, in the case of third-party content, the entity that is credited as the owner of such content. OIAA authorizes you to view and use the content on the Site solely for your personal, noncommercial use, without altering or removing any trademark, copyright, or other notice from such material. The use of the content on any other site, including by linking or framing, or in any networked computer environment for any purpose is prohibited without OIAA’s prior written approval.
OIAA periodically may give users opportunity to upload content to the Site and may host programs or events through the Site which may give rise to creation of content (including videos of performances) which may be subject to the terms of negotiated usage agreements. In the absence of any provision in such agreements to the contrary, all users hereby grant to OIAA an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such content (including, without limitation, your image and voice) for any purpose, and to prepare derivative works of, or incorporate into other works, such content.
User Generated Content
OIAA may provide users an opportunity to post content to the website. OIAA does not necessarily endorse, support, sanction, encourage, or agree with content posted by users or any content discussed at meetings listed at the Site.
Users who add content to the Site on behalf of member groups agree to update their listings of A.A. meetings and comply with OIAA’s PAC Policies. Content must not be false, inaccurate, or misleading. Content shall not be unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.
You shall not post or transmit any unlawful threatening, harassing, abusive, libelous, slanderous, defamatory, obscene, lewd, vulgar, pornographic, profane, indecent or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil or criminal liability, or otherwise violate and local, state, national, or international law, or infringe upon another’s copyright, trademark, or intellectual property rights or violate the privacy or publicity rights of any third party. Any such posting or transmission may result in a suspension or cancellation of your privileges at the sole discretion of OIAA. If we suspend or cancel your account or meeting listing for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to suspending or cancelling your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
You understand that all information, data, text, software, music, sound, photographs, video, messages, or other materials posted on the Site, whether publicly posted or privately transmitted, is the sole responsibility of the person from whom such content originated. This means that you, and not OIAA, are entirely and solely responsible for all content that you access, upload, download, post, or otherwise transmit via the Website.
While OIAA reserves the right to monitor content posted by users, including A.A. meeting listings posted on the Website, OIAA has no obligation to do so, and cannot ensure review of all information posted at the Site. OIAA is not responsible for such content. OIAA shall have the right, but not the obligation, to delete, move, or edit any content that violates these Terms or is otherwise objectionable or inappropriate as determined by OIAA at its sole discretion and without notice.
If you upload, post, or otherwise transmit content to the Website, you acknowledge that any such submissions may be edited, removed, modified, published, transmitted, and displayed by OIAA in any medium now existing or hereinafter invented, and for any purpose, including commercial uses.
Guidelines for Email and Digital Communications
OIAA may provide areas on the Site to submit email questions, complaints and correspondence, and other digital interactions. When communicating, you must comply with the following criteria:
- you should have firsthand experience with the person/entity being or situation you are referring to;
- your communication should not contain offensive profanity, or abusive, racist, offensive, or hate language;
- your communication should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability;
- your communication should not contain references to illegal activity;
- you should not make any conclusions as to the legality of conduct; and
- you may not post or communicate any false, slanderous, or misleading statements;
OIAA does not assume liability for any digital communications or for any claims, liabilities, or losses resulting from such communications.
Social Media
As part of the functionality of the Site, you may link your account with online accounts you have with third-party service providers (each such account, a “Third-Party Account”) by either providing your Third-Party Account login information through the Site or allowing access your Third-Party Account, as is permitted under the applicable terms and conditions that govern your use of each Third-Party Account.
You represent and warrant that you are entitled to disclose your Third-Party Account login information to OIAA and/or grant access to your Third-Party Account, without breach by you of any of the terms and conditions that govern your use of the applicable Third-Party Account, and without obligating OIAA to pay any fees or making OIAA subject to any usage limitations imposed by the third-party service provider of the Third-Party Account. If a Third-Party Account or associated service becomes unavailable or our access to such Third-Party Account is terminated by the third-party service provider, then social network content may no longer be available on and through the Site. You will have the ability to disable the connection between your account on the Site and your Third-Party Accounts at any time.
OIAA makes no effort to review any social network content for any purpose, including but not limited to, for accuracy, legality, or non-infringement, and OIAA is not responsible for any social network content.
Indemnification
You agree to defend, indemnify, and hold harmless OIAA and its officers, directors, employees, and agents, from and against any and all claims, losses, damages, liability, or demands, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of:
- your use of the Site;
- your user-generated content;
- your submission of information or A.A. meetings listings;
- breach of these Terms;
- your violation of the rights of a third party, including but not limited to intellectual property rights or privacy rights; or
- any overt harmful act toward any other user of the Site with whom you connected via the Site.
Notwithstanding the foregoing, OIAA reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify, and you agree to cooperate, at your expense, with defense of such claims. OIAA will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
Jurisdiction
You agree that any claim, action, or proceeding arising out of these Terms, or your use of the Website, shall be governed by and construed in accordance with the laws of the State of New Jersey applicable to contracts to be wholly performed therein, without regard to its conflict of law principles. By using the Site, you agree that any action based on or alleging a breach of these Terms must be brought in a state or federal court in New Jersey. In addition, you agree to submit to the personal jurisdiction of such courts.
Miscellaneous
These Terms and any policies or operating rules posted by OIAA on the Site constitute the entire agreement and understanding between you and OIAA. Any failure by OIAA to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
OIAA may assign or transfer the Website any or all of OIAA’s rights and obligations to others at any time.
If any provision or part of a provision of these Terms is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
There is no joint venture, partnership, employment, or agency relationship created between you and OIAA as a result of these Terms or use of the Site.
You hereby waive any and all defenses you may have based on the electronic form of these Terms and the lack of signing by the parties hereto to execute these Terms.
